Francis Dyer of Marathon, Florida was arrested Sunday after he allegedly broke into his brother's home and attacked his brother and his brother's girlfriend, news sources say. The girlfriend in question was also Dyer's ex-girlfriend and had apparently started dating Dyer's brother only recently. Dyer, 37, was booked into the Monroe County Jail on charges of assault, battery, criminal mischief, and burglary following the incident. A bail bond was not set. It is not yet known whether Dyer has hired a lawyer.
Reports say the incident occurred sometime Sunday afternoon. Dyer was reportedly distraught after he learned that his ex-girlfriend, who reports did not identify by name, had left him for his brother. Upset, Dyer alleged walked to his brother's home, where his brother and the woman were together. Dyer ended up breaking into the house and an argument ensued. Dyer then purportedly began to physically fight with his sibling, who reports also did not identify. At some point, the girlfriend also became involved in the fight.
The two brothers fought and at some point police were called to scene, reports say. When officers arrived, they witnessed Dyer leaving the home. The detectives entered the home and interviewed the brother and the female victim. Reports say the brother sustained head injuries during the alleged fight; the woman also sustained contusions in the struggle, reports indicate. Both victims alleged that Dyer showed up to the home and unlawfully made his way inside. They also allege that Dyer tossed something through a window, damaging the home. At one point, the female victim says she started to call an emergency number but stopped when Dyer threatened her life.
It is unclear whether Dyer has made a statement regarding the allegations. Reports say he was uncooperative during his incarceration and that additional charges may follow.
Dyer was not the only Florida resident accused of battery recently. Kelvis Maiguel of Naples, Florida was arrested Thursday after he allegedly undressed his female roommate from the waist down as she slept, reports indicate. Maiguel, 38, was booked into jail on one count of battery. He was later released after posting a $2,000 bail. It is unknown whether he has hired legal representation.
Reports say Maiguel and the victim share an apartment together at the Grand Cypress Circle, though it is not clear whether the pair are dating or intimately involved. The alleged incident occurred early in the morning after the victim, Maiguel, and a group of friends returned home from a night of drinking at local bars. Reports say the victim fell asleep on a couch and Maiguel fell asleep in the kitchen. At some point, Maiguel woke up and approached the victim. Reports say he undressed himself from the waist down and then undressed the female victim similarly. However, the victim awoke and found Maiguel standing over her. She reportedly told Maiguel, "no, no stop it," and it appears as though Maiguel complied.
The victim told police she awoke before Maiguel had a chance to do anything to her. Maiguel reportedly told officers that he was not going to violate the woman sexually. During questioning, Maiguel allegedly admitted to undressing the victim.
